AGREEMENT AND RELEASE - PHYSICAL/EXERCISE ACTIVITIES WAIVER FORM

By signing this Release, I, as a voluntary participant in physical exercise, training, tournaments, camps, parties, or other organized activities sponsored or facilitated by Vistara Sports, Texas Badminton Center, Texas Badminton Academy, Texas Pickleball Center, or Texas Table Tennis Center and its affiliates (collectively, the "Vistara Organization"), including but not limited to sports, wellness, dance, fitness, and recreational activities, acknowledge and agree to the following terms:

1. Assumption of Risk and Release of Liability

I understand and agree to the following:

I voluntarily assume all risks associated with participation in the above-described activities and any related events, including risks of injury, illness, or death.
I release, indemnify, and hold harmless the Vistara Organization, its affiliates, officers, directors, employees, contractors, and agents from any liability, claims, or damages from my participation.
I acknowledge that certain facility features (e.g., proximity to walls, pillars, fixed objects, sports surface, indoor temperature & moisture) may increase the risk of injury, and I accept these risks knowingly.

2. Facility Rules and Policies

I agree to comply with all facility rules, including but not limited to:

Wearing appropriate footwear (e.g., non-marking indoor shoes) on designated surfaces.
Accepting responsibility for any damage I cause to the facility infrastructure.
Understanding that any approved refunds may be issued as Vistara Organization gift cards, which may have expiration dates.

Court Reservation Cancellation Policy:

Cancellations <24 hours before reservation: No refund
Cancellations 24–48 hours before reservation: 50% refund (gift card)
Cancellations 48–72 hours before reservation: 100% refund (gift card)

I agree to abide by the full facility policy posted at: https://vistarasports.com/facility_policy. I understand that this policy may change with or without notification to me.

3. Media Release and Consent

I grant Vistara Organization and its affiliates the nonexclusive, royalty-free right to use my image, testimonial, and participation in all media formats, including but not limited to:

Print, video, digital platforms, social media, advertising, and promotional materials.

I confirm I am not a minor and have the authority to grant this consent. I waive any right to financial compensation for such use. I release Vistara Organization from any claims related to the use of my likeness or testimonial.

4. Participant Certification

By signing below, I certify that:

I have read and understood this agreement.
I am 18 years of age or older and mentally competent.
I am in good health and physically able to participate in the activities described.
If signing on behalf of a minor, I confirm I am the legal parent or guardian and authorized to provide consent.
